OVERVIEW

Welcome to Voya Global eSIM (“Voya Global eSIM”, “we”, “us”, “our”). We operate this website and store, and provide all related information, content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (these “Terms”), together with any policies referenced herein (including our Privacy Policy [LINK] and Refund Policy [LINK]), describe your rights and responsibilities when using the Services. By visiting, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

SECTION 1 – ACCESS AND ACCOUNT

You represent that you are the age of majority in your jurisdiction, or you have consented to allow your minor dependents to use the Services on devices you own or manage. You may be asked to provide information such as your name, email, billing and payment details. You warrant that all information you submit is accurate, current, and complete and that you have the right to provide it. You are responsible for safeguarding your account credentials and all activity under your account. You may not sell, assign, or transfer your account.

SECTION 2 – OUR PRODUCTS (DIGITAL eSIM & PHYSICAL GOODS)

We strive to describe products accurately; however, colors/appearance may vary due to device settings. We do not warrant that any products or Services will meet your expectations. Descriptions and availability may change without notice. We may discontinue or limit products, including by customer, region, or jurisdiction.

SECTION 3 – ORDERS

Your order is an offer to purchase. We may accept or decline any order at our discretion; acceptance occurs only when we confirm it and process payment. Review orders carefully—cancellations might not be possible once accepted. If we decline or modify an order, we will attempt to notify you using the contact details provided. Purchases are subject to our Refund Policy [LINK]. You represent purchases are for personal/household use and not for resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price in effect at order time applies and will appear in your confirmation email. Unless stated, prices exclude taxes, duties, customs, import charges, shipping, and handling. Promotions may have separate terms; if conflicting, promotion terms govern. You agree to provide current and accurate payment details and authorize us (and our payment processors) to charge your selected payment method for all amounts due, including applicable taxes and fees.

SECTION 5 – SHIPPING AND DELIVERY (PHYSICAL GOODS)

Delivery times are estimates only and not guaranteed. We are not liable for delays due to carriers, customs, or events beyond our control. Title and risk of loss pass to you upon transfer to the carrier.

SECTION 6 – INTELLECTUAL PROPERTY

All content and materials within the Services (including trademarks, text, images, graphics, audio/video, and the design and arrangement thereof) are owned by Voya Global eSIM, its affiliates, or licensors, and are protected by intellectual-property laws. You may use the Services for personal, non-commercial use only. Except as expressly permitted, you may not copy, modify, distribute, display, perform, or create derivative works from the Services without our prior written consent. Voya Global eSIM names and logos are trademarks of Voya Global eSIM or its affiliates. Shopify names and logos are trademarks of Shopify. All other marks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools or features from third parties on an “as is” and “as available” basis without warranties or endorsement. Use of such tools is at your own risk and subject to the third party’s terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may link to third-party websites or include third-party content. We are not responsible for examining or evaluating such content and assume no liability for your use of third-party sites, products, or services. Review third-party policies before engaging in any transaction.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Note to Merchant: This section is required by Shopify and should not be removed or modified.
The Services are powered by Shopify. Sales you make or receive are solely between you and Voya Global eSIM. Shopify is not responsible for any sales, products, services, or disputes between you and Voya Global eSIM. You expressly release Shopify and its affiliates from claims arising from your transactions with Voya Global eSIM.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is subject to our Privacy Policy [LINK]. Because the Services are hosted by Shopify, some personal information may also be processed by Shopify in accordance with Shopify’s privacy policies available here. Information you submit may be transmitted to and processed in countries other than where you reside. See our Privacy Policy [LINK] for details.

SECTION 11 – FEEDBACK

If you submit reviews, ideas, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose. You represent that you own or have rights to the Feedback and that it complies with these Terms and applicable law. We may monitor, edit, or remove Feedback in our discretion. You are solely responsible for your Feedback.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may contain errors or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct or update information or cancel orders if any information is inaccurate, at any time and without notice, including after you submit an order.

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes. You may not, directly or indirectly: (a) violate laws or third-party rights; (b) infringe intellectual property; (c) harass, defame, or harm others; (d) transmit misleading information; (e) send spam or unauthorized promotions; (f) impersonate others; (g) upload malware; (h) scrape or harvest data; (i) interfere with security features; or (j) engage in conduct that, in our judgment, harms Voya Global eSIM, Shopify, users, or exposes them to liability. We may suspend or terminate access for violations.

SECTION 14 – TELECOM-SPECIFIC TERMS (eSIM SERVICE)

  1. Device Compatibility & Unlocking. You are responsible for ensuring your device supports eSIM, is carrier-unlocked, and compatible with the selected plan and local networks.

  2. Activation & Start Times. Delivery of QR code/SM-DP+/activation code constitutes delivery of digital content. Some plans must be activated within a stated window (e.g., 30 days from purchase) and/or start upon first network registration.

  3. Coverage & Performance. Service availability, speeds, latency, tethering/hotspot, VoLTE/5G access, and quality vary by carrier, location, building materials, device, and network load. Fair Use Policies (FUP) and traffic management may apply. Advertised speeds are not guaranteed.

  4. Roaming & Usage. Plans are for normal, personal use in the specified country/region. We may restrict or suspend service for fraud, SIM boxing, excessive tethering, unauthorized commercial use, abuse, or violation of law or FUP.

  5. Numbering & Calls. Unless expressly stated, data-only eSIMs do not include voice/SMS or local numbers. App-based calling/messaging relies on third-party services outside our control.

  6. Support & Troubleshooting. You agree to follow our setup and troubleshooting steps (e.g., APN, data-roaming toggles, device restarts, network re-selection, providing diagnostic screenshots/speed tests) before we can assess issues or refunds (see Refund Policy [LINK]).

  7. Emergency Calls. eSIM data services may not support emergency calling. Keep an alternative method available to contact emergency services.

SECTION 15 – SUSPENSION; TERMINATION

We may suspend, restrict, or terminate the Services or your access at any time, with or without notice, including for suspected fraud, misuse, chargebacks, or security concerns. You remain responsible for fees incurred up to termination. Sections intended to survive termination will do so, including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy.

SECTION 16 – DISCLAIMER OF WARRANTIES

Except as expressly stated by Voya Global eSIM, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers, so the foregoing may not apply to you.

SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Voya Global eSIM and its officers, employees, partners, affiliates, agents, contractors, service providers, and licensors (and Shopify and its affiliates) shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages; loss of profits, revenue, data, or goodwill; or replacement costs arising from or related to your use of the Services or any products, even if advised of the possibility. Our aggregate liability for direct damages shall not exceed the amount you paid for the product or Service giving rise to the claim.

SECTION 18 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Voya Global eSIM, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your: (1) breach of these Terms or incorporated policies; (2) violation of law or third-party rights; or (3) access to or use of the Services. We may assume control of the defense at your expense; you will cooperate with us.

SECTION 19 – SEVERABILITY

If any provision of these Terms is unlawful, void, or unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.

SECTION 20 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any provision is not a waiver. These Terms, together with policies posted on the site, constitute the entire agreement between you and us and supersede prior agreements regarding the Services. Ambiguities shall not be construed against the drafter.

SECTION 21 – ASSIGNMENT

You may not assign or transfer these Terms or any rights/obligations without our prior written consent. We may assign or transfer these Terms without notice.

SECTION 22 – GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services are governed by the laws and courts of the jurisdiction where Voya Global eSIM is headquartered. You consent to venue and personal jurisdiction in such courts.

SECTION 23 – CHANGES TO TERMS

You can review the most current version of these Terms on this page. We may update or replace portions of these Terms by posting changes on the website. We will provide notice of material changes as required by law, and changes take effect on the date stated in the notice. Continued use after changes constitutes acceptance.
